Hanze Collectie
General Terms and Conditions
Article 1 – Definitions
In these general terms and conditions, the following definitions apply:
Hanze Collectie: the enterprise that offers art, antiques, porcelain, ceramics, collectibles, and related goods through its webshop.
Customer: any natural or legal person who enters into an agreement with Hanze Collectie.
Consumer: a natural person acting for purposes outside their business or professional activity.
Object: any art, antique, porcelain, ceramic, collectible, or other object offered by Hanze Collectie.
Agreement: any agreement between Hanze Collectie and the customer regarding the purchase of an object.
Article 2 – Applicability
- These general terms and conditions apply to every offer from Hanze Collectie and to every agreement between Hanze Collectie and the customer.
- By placing an order, the customer agrees to these general terms and conditions.
- Deviations from these terms are only valid when agreed upon in writing with Hanze Collectie.
- If a provision in these terms is found to be void or unenforceable, the remaining provisions will remain in effect.
Article 3 – Offer and object descriptions
- Hanze Collectie takes great care in the description and photography of the objects offered.
- Due to the nature and age of antique, vintage, and used objects, signs of age, wear, discoloration, craquelure, firing imperfections, restorations, minor damage, and other signs of use may occur.
- Such characteristics may be inherent to the age and character of the object and are, as far as known and reasonably relevant, presented in the description and/or photos.
- Photos are part of the object presentation. Customers are advised to carefully view all available photos before making a purchase.
- Colors may vary slightly from the actual object due to photography, lighting, and screen settings.
- Stated dimensions and weights are determined as accurately as possible, but minor deviations may occur.
Article 4 – Dating, origin, and attribution
- Hanze Collectie strives to state information regarding dating, period, maker, place of production, origin, material, and style as carefully as possible.
- For art and antiques, such information may also be based on stylistic features, comparative material, available documentation, and the knowledge available at the time of sale.
- When an attribution or dating cannot be determined with certainty, Hanze Collectie may use terms such as “presumed,” “attributed to,” “in the style of,” “after,” “likely,” “circa,” or similar formulations. These terms explicitly indicate that it is an estimate and not an absolute determination.
- New information or changing insights within the art and antique market may lead to an object being dated or attributed differently later.
- The above does not prejudice the legal rights of consumers and does not relieve Hanze Collectie of its obligation to provide correct information and deliver an object that complies with the agreement.
Article 5 – Condition
- The offered objects are, unless explicitly stated otherwise, not new.
- With antique and used objects, normal traces related to age, method of manufacture, and use must be taken into account.
- To the extent that Hanze Collectie has identified relevant damage or restorations, these will be stated or depicted photographically to the best of its knowledge.
- A condition description is intended as a practical explanation and does not constitute a professional restoration or conservation report, unless explicitly stated.
- Customers can request additional information or photos regarding the condition of an object before purchase.
Article 6 – Prices
- All prices stated on the website are in euros, unless otherwise indicated.
- Applicable taxes will be processed in accordance with the tax regulations applicable to the respective sale.
- Any shipping, transport, or other additional costs will be shown to the customer before the order is completed.
- Obvious typing, pricing, and input errors do not bind Hanze Collectie to the extent that the customer could reasonably have understood that there was an error.
Article 7 – Formation of the agreement
- The agreement is concluded after the order has been accepted by Hanze Collectie.
- Hanze Collectie reserves the right to refuse or cancel an order if there is a justified reason, for example, if an object is unexpectedly no longer available or if there is an obvious error in price or description.
- If an already paid object cannot be delivered, the amount paid for that object will be refunded.
Article 8 – Payment
- Payment takes place via the payment methods offered during checkout.
- Unless otherwise agreed, the full purchase amount must be paid before the object is shipped or picked up.
- The object remains the property of Hanze Collectie until the full amount due has been paid.
Article 9 – Delivery and shipping
- Hanze Collectie packs objects with care and in a manner appropriate to the nature of the object.
- The estimated delivery time will be stated with the order where possible.
- A stated delivery time is an indication, unless explicitly agreed otherwise or the law dictates otherwise.
- The customer is responsible for providing correct and complete address details.
- If a package is returned due to incorrect or incomplete address details provided by the customer, reasonable costs for a new shipment may be charged to the customer.
- For consumers, the risk of loss or damage generally transfers to the consumer as soon as they, or a third party designated by them who is not the carrier, has received the object, subject to legal exceptions.
Article 10 – Right of withdrawal for consumers
- A consumer who enters into a distance contract via the webshop generally has the legal right to withdraw from the contract within 14 days of receipt without giving reasons, unless a legal exception applies.
- The consumer must inform Hanze Collectie unequivocally of their decision to withdraw from the contract within the withdrawal period.
- After withdrawal, the object must be returned within the legal term.
- The consumer must handle the object and its packaging with care. The consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
- The direct costs of returning are for the account of the consumer, insofar as this has been correctly communicated to the consumer in advance.
- Hanze Collectie will refund the amounts due by law within the applicable legal period and may, where legally permitted, wait until the object has been received or the consumer demonstrates that it has been returned.
- The right of withdrawal only applies when and insofar as the law prescribes it.
Important: the fact that you sell antiques does not mean that you can standardly state "no returns possible" for online consumer sales. For normal sales via your own webshop, the legal right of withdrawal generally applies.
Article 11 – Returns
- A return shipment must be carefully and properly packaged, preferably with the same degree of protection as when the object was received.
- The consumer is advised to use a shipping method with tracking and, given the nature and value of antique objects, an insured shipping method where appropriate.
- If an object has diminished in value due to handling by the consumer, Hanze Collectie may claim compensation for that diminished value within the limits of the law.
Article 12 – Damage during transport
- The customer is requested to check the package and the object as soon as possible after receipt.
- If an object arrives damaged, the customer is requested to inform Hanze Collectie as soon as possible and provide clear photos of:
- the object;
- the damage;
- the inner packaging;
- the outer packaging; and
- if relevant, the shipping label.
- This notification helps Hanze Collectie in handling the damage and any claim with the carrier and does not limit the legal rights of consumers.
Article 13 – Conformity and complaints
- Hanze Collectie guarantees that a sold object meets what the customer could reasonably expect based on the agreement and the information provided.
- If a customer believes that an object does not comply with the agreement, the customer must inform Hanze Collectie thereof within a reasonable period.
- Complaints will be handled substantively as soon as possible.
- Legal rights of consumers regarding non-conformity are not limited by these terms.
Article 14 – Liability
- Hanze Collectie is not liable for damage resulting from normal use, normal age, natural material effects, or characteristics that were clearly described or made visible before purchase, to the extent that such exclusion is legally permitted.
- Hanze Collectie is not liable for indirect or consequential damage to the extent that such a limitation is legally permitted.
- No provision in these terms limits liability that cannot be excluded or limited under mandatory law.
Article 15 – Intellectual property
All texts, photos, design, and other content of the Hanze Collectie website may not be copied, published, or used for commercial purposes without prior permission, insofar as Hanze Collectie holds intellectual property rights thereto.
Article 16 – Personal data
Hanze Collectie processes personal data in accordance with applicable privacy legislation and the privacy policy published on the website.
Article 17 – Applicable law
- Agreements with Hanze Collectie are governed by Dutch law.
- Disputes will be submitted to the competent court, taking into account the legal rules that protect consumers.
- If the consumer resides in another EU country, the choice for Dutch law does not affect the mandatory consumer protection that the consumer can claim under the law of their country of residence.
